This is Daisy. I am glad to be the host on August 15. Today I want to talk about your health, safety and welfare at work as protected by law. Nowadays most people need to work everyday: five days a week, eight hours a day at least. Work is one of the most important things in our daily life, but have you ever thought about your health, safety and welfare at work?

The range of the laws related is wide, which covers various fields in health examination, employee’s insurance, fire safety at work site, employees’ personal safety, employees’ restaurant, and employees’ incentives (stocks or cash). Please read the following article, prepare the vocabulary you may need to discuss this brand new topic which has immediate concern to yourselves.

Your health, safety and welfare at work are protected by law

Your employer has a duty to protect you and keep you informed about health and safety. You have a responsibility to look after yourself and others. If there is a problem, discuss it with your employer or safety representative, if there is one.

This leaflet is a brief guide to health and safety law. It does not describe the law in detail, but it does list the key points. Your employer has a duty under the law to ensure, so far as is reasonably practicable, your health, safety and welfare at work.

In general, your employer's duties include:
*making your workplace safe and without risks to health;
 *ensuring plant and machinery are safe and that safe systems of work are set and followed;
 *ensuring articles and substances are moved, stored and used safely:
 *providing adequate welfare facilities;
 *giving you the information, instruction, training and supervision necessary for your health and safety.

In particular, your employer must:
*assess the risks to your health and safety;
 *make arrangements for implementing the health and safety measures identified as being necessary by the assessment;
 *if there are five or more employees, record the significant findings of the risk assessment and the arrangements for health and safety measures

As an employee you have legal duties too. They include:
*taking reasonable care for your own health and safety and that of others who may be affected by what you do or do not do;
*co-operating with your employer on health and safety;
 *correctly using work items provided by your employer, including personal protective equipment, in accordance with training or instructions; and
 *not interfering with or misusing anything provided for your health, safety or welfare.

Section II
There are some laws related to labor in Taiwan, such as Labor Standards Law, which protect us in basic health and safety. Here I have a mini test to help you understand your knowledge in your rights under these laws. Please discuss the following questions to see whether they are true or false, and I’ll give out the answers after each group has presented its summary.
1.Employees must be paid on typhoon leaves.

2.Company must offer health examination to their employees on a regular time schedule.

3.Employee incentives (stock or cash) are a trick which some big companies use to keep excellent employees to work for them.

4.There are no applicable laws in which we can claim compensation from the government when our family member dies or our family member can claim compensation from the government when we die.

5.When we are away on business, the company must pay for our travel expense, hotel expense, and life expense.

Answers to the mini test:
1. The answer is FALSE. It depends on the company’s policy.
(76) 台勞動字第3928號:天然災害發生時,停止辦公通報及起訖時間,應以事業單位所在地政府首長發布之通報為依據,如經宣佈停止工作或勞工確因居住地發生災害無法到工者,工資應如何發給,可由勞資雙方自行協商。

2. The answer is TRUE. not only government agencies but also all private companies must offer health examination to their employees.
根據勞工安全衛生法第十二條規定【雇主於僱用勞工時,應施行體格檢查;對在職勞工應施行定期健康檢查;對於從事特別危害健康之作業者,應施行特定項目之健康檢查;並建立健康檢查手冊,發給勞工】。

3. The answer is FALSE. Every company must award its employees with incentives.
員工紅利是依公司法第235條規定,不可刪除;但%數是可以由股東訂定章程時決定的,1%或0.6%或5%都可,只是未來公司有盈餘也經各股東同意分配時就必需以該%數給付,而給付對象也並未指定,故雇主可以只發給特定員工。

4. The answer is FALSE. According to Labor Insurance Law (勞工保險條例), each labor can get compensation when their spouse, parent, child dies.

家屬死亡給付簡介
一、 請領給付要件
被保險人之父母、配偶或子女死亡時,得請領喪葬津貼。按所稱父母、子女係指生身父母、養父母、婚生子女(包括依民法規定視為婚生子女者),或已依法收養並於死亡之日止辦妥戶籍登記滿6個月之養子女而言。 
二、 給付標準
喪葬津貼按家屬死亡之當月起前6個月(含事故當月)被保險人平均月投保薪資,依下列標準發給。
父母或配偶死亡時,發給3個月。
年滿12歲之子女死亡時,發給2個半月。
未滿12歲之子女死亡時,發給1個半月。  

本人死亡給付簡介
一、 請領資格:
被保險人死亡,其遺屬或負責埋葬者得請領喪葬津貼。
被保險人死亡,遺有配偶、子女及父母、祖父母或專受其扶養之孫子女及兄弟、姐妹者得請領遺屬津貼。
前項所稱父母、子女係指生身父母、養父母、婚生子女﹝包括依民法規定視為婚生子女者﹞,或已依法收養並辦妥戶籍登記滿6個月之養子女而言。被他人收為養子女者,不得請領生身父母死亡之遺屬津貼。
受領遺屬津貼之順序如下:
1.配偶及子女。
2.父母。
3.祖父母。
4.專受被保險人生前扶養之孫子女。
5.專受被保險人生前扶養之兄弟、姐妹。

二、 給付標準:
被保險人死亡,按其死亡當月起前6個月(含事故當月)平均月投保薪資發給5個月喪葬津貼。
被保險人因普通傷病死亡,按其死亡當月起前6個月(含事故當月)平均月投保薪資發給遺屬津貼,其給付標準如下:
參加保險年資合計未滿1年者發給10個月
參加保險年資合計滿1年而未滿2年者,發給20個月
參加保險年資合計已滿2年者,發給30個月。
被保險人因職業傷害或職業病死亡者,不論其保險年資,一律發給40個月遺屬津貼。
被保險人死亡前請領殘廢給付或老年給付,經保險人審定應給付者,在未領取該項給付前死亡,又無勞保條例所規定之受益人者,由負責埋葬者請領10個月喪葬津貼,其殘廢給付或老年給付不予給付。
自民國87年3月9日起,勞保被保險人死亡時,無勞工保險條例第65五條所定之遺屬者,得按被保險人平均月投保薪資給與負責埋葬者,10個月喪葬津貼。

5. The answer is FALSE. If the trip is over one day, than company can pay it but only ticket and hotel expense is necessary. Life expense in not necessary and also have upper limit.
營利事業所得稅查核準則第74條旅費支出之認定標準如下:
(一) 膳宿雜費:除國內宿費部分,應取得旅館業書有抬頭之統一發票或普通收據,予以核實認定外,國內出差膳雜費及國外出差膳宿雜費日支金額,不超過下列最高標準者,無須提供外來憑證,准予認定:
1. 國內出差膳雜費:營利事業之董事長、總經理、經理、廠長每人每日七百元。 其他職員,每人每日六百元。
2. 國外出差膳宿雜費:比照國外出差旅費報支要點所定,依中央政府各機關派赴國外各地區出差人員生活費日支數額表之日支數額認定之。但自行訂有宿費檢據核實報銷辦法者,宿費部分准予核實認定外,其膳雜費按上述標準之五成列支。
3. 營利事業派員赴大陸地區出差,其出差之膳宿雜費比照國外出差旅費報支要點所定,依中央政府各機關派赴大陸地區出差人員生活費日支數額表之日支數額認定之。

補充
勞動基準法第一條規定,公司的任何規定及標準不得低於此法規定,我認為值得大家好好研究

一.生育給付:分娩費30日
二.傷病給付:普通(住院)=>第4天起50%(最多一年)職業(住院/無法工作/未取原有薪資)=>第4天起70%(次年50%,最多二年)
三.老年給付:最高45~50個月(189~210萬)
四.死亡給付:一年內15個月,未滿2年25個月,2年以上35個月。
五.殘廢給付:依殘廢程度分為十五等級177項
